General Conditions of Sale - July 2026

 

1.          Your Contract with Us

a.                  These general conditions of sale (hereinafter, the GCS), divided into sections (each, a Section), apply to all sales and purchases of FIFA World Cup 2026™ (the World Cup) championship rings (each, a Ring, collectively, the Rings) that you, as the client, order from YS Partners SA, a Swiss company limited by shares with its registered office at rue des Alpes 5, 1201 Genève (YSP), via a dedicated website (hereinafter, the Site). In placing an order, you acknowledge that you have read, understood and accepted these GCS without reservation.

b.                 YSP reserves the right to amend these GCS at any time by publishing a new version on the Site. Any order or product delivery occurring after the publication of a new version shall be governed by the version accepted by the client at the time of the relevant order, subject to any mandatory provisions of applicable law.

c.                  The GCS in force on the Site at the time of the acquisition on the secondary market of a Ring shall also apply, insofar as applicable, to any subsequent purchasers of a Ring.

d.                 By using the Site, you agree to be bound by our Privacy Notice.

e.                  YSP may use third-party e-commerce and payment processing platforms, including Shopify and its integrated or affiliated service providers, to host the Site, process orders, collect payments, manage order confirmations, and maintain order records. You acknowledge and accept that the placement and administration of orders may therefore be subject to the terms of use of such third-party platforms and service providers.

f.                  YSP acts at all times as an independent entity, in its own name and for its own account. YSP does not represent FIFA in any capacity and has no authority to act for or bind FIFA. The Rings are marketed and sold exclusively in the name and for the account of YSP. FIFA shall not be liable in any case in connection with the marketing, sale, delivery or purchase of the Rings.

2.          Ordering Mechanisms

2.1.          Winning Design

a.                  By July 15, 2026, or at the latest as soon as the two World Cup finalists are known (Finalist A and Finalist B, each a Finalist), YSP will publish on the Site two Ring designs: one design specific to the nation of Finalist A (Design A) and one design specific to the nation of Finalist B (Design B) (each, a Design).

b.                 The Rings will be produced and sold by YSP exclusively using the Design of the Finalist that wins the World Cup (the Winning Design). For the purposes of these GCS, the Winning Design shall be exclusively determined by YSP immediately after the end of the World Cup final match (the Final Match).

2.2.          Binding Order

a.                  When placing an order on the Site, you will be invited to choose between (i) an unconditional purchase of a Ring (Section 2.3) and (ii) the conditional purchase of a Ring (Section 2.4). The submission of an order through the Site constitutes an offer by the client to purchase a Ring (the Order).

b.                 You acknowledge and agree that the Rings are produced in a limited and non-increasable quantity determined by YSP. The Orders are recorded in an edition queue.  

2.3.          Unconditional Purchase

2.3.1          Product

Under the unconditional purchase mechanism, you will purchase the Ring on the understanding that it will bear the Winning Design determined by YSP (the Unconditional Purchase).

2.3.2          Payment

The price of the Ring (the Price) is payable by the client in full at the time of the Order.

2.3.3          Binding Contract

A binding purchase contract is formed once the Price is received in full by YSP.

2.3.4          Edition Number

Edition numbers are assigned by Order timestamp. In the case of wire transfer, the relevant edition number is reserved at Order placement and confirmed upon receipt of the Price. If the Price is not received in accordance with the applicable payment instructions or within the period indicated by YSP, YSP may release the reserved edition number and cancel the Order.

2.4.          Conditional Purchase

2.4.1          Product

Under the conditional purchase mechanism, when proceeding with the placement of your Order, you will be invited to select either Design A or Design B (the Selected Design). You will purchase the Ring on the condition that the Winning Design corresponds to the Selected Design (the Conditional Purchase).

2.4.2          Deposit  

You shall pay a deposit determined by YSP to secure a place in the edition queue for the Selected Design (the Deposit).

2.4.3          Binding Contract

A binding conditional purchase contract is formed once the Deposit is received in full by YSP. The Order shall be registered in the edition queue for the Selected Design.  

2.4.4          Conversion Window

a.                  Provided that the Order’s place in the edition queue permits the purchase in accordance with your Order, as soon as the Winning Design has been determined by YSP after the Final Match, YSP will send an electronic notification (via e-mail) to you with the following instructions:

aa.               If the Winning Design corresponds to the Selected Design, you shall pay the remaining balance of the Price (i.e., the Price minus the Deposit) within three (3) days after the end of the Final Match (in any case, no later than July 22, 2026, 23:59 CET) (the Conversion Window). If the remaining balance of the Price is not received in accordance with the applicable payment instructions or within Conversion Window, the Deposit shall be forfeited, and YSP will release the reserved edition number to the next Order in the edition queue and cancel your Order. Any Order cancellation shall release YSP from any contractual obligation under these GCS.

bb.              If the Winning Design does not correspond to the Selected Design, your Order shall be cancelled, and the Deposit shall be refunded, unless you modify the Order within the Conversion Window (no later than July 22, 2026, 23:59 CET), by accepting the Winning Design instead of the Selected Design and paying the remaining balance of the Price in accordance with Section 2.4.4.a.aa. If you modify your Order, and the remaining balance of the Price is not received in accordance with the applicable payment instructions or within Conversion Window, the Deposit shall be forfeited, and YSP will release the reserved edition number to the next Order in the edition queue and cancel your modified Order. Any Order cancellation shall release YSP from any contractual obligation under these GCS.

b.                 YSP reserves the right to adjust the deadlines set out in this Section in the event of a postponement of the Final Match or any other unforeseen event affecting the Final Match.

c.                  YSP reserves the right to refund wholly or in part any forfeited Deposit as a gesture of goodwill, on a case-by-case basis.  

2.4.5          Limited Quantity Exhaustion

If the limited quantity of Rings is exhausted before the client’s turn in the edition queue is reached, your Order shall be cancelled, and the Deposit shall be refunded. YSP may, however, in its sole discretion, keep your Order in force during and after the Conversion Window and offer you the opportunity to purchase the Ring(s) in accordance with your Order if, after the Conversion Window, Rings are still available.  

2.4.6          Edition Number

Edition numbers are reserved at Order placement and confirmed upon timely payment of the outstanding balance of the Price within the Conversion Window. In the event of (i) Order forfeiture (Section 2.4.4) or (ii) withdrawal (Section 12), the corresponding edition number shall be released in favor of the next Order in the edition queue.

2.5.          Purchase Cap

The maximum quantity that may be purchased per Order is three (3) Rings, unless specifically agreed and confirmed by YSP. YSP reserves the right to refuse, cancel or adjust any Order or series of Orders placed in excess of this limit.

3.          Product Offering

a.                  Rings are offered for sale on the Site within the limits of available stock and production capacity. YSP may, at any time and without liability, discontinue, limit or modify any offering before a binding contract is formed.

b.                 Photos, renderings and texts illustrating and describing the Rings displayed on the Site are non-contractual and provided for information purposes only. However, where the Site displays Design A and Design B, such display is intended to allow the client to identify the applicable design before committing to the relevant Ring under Section 2.4.1.

4.          Prices, Shipping Costs and Taxes

All prices displayed on the Site include free worldwide shipping costs, but exclude any VAT, sales tax, customs and duties. All taxes, customs duties and similar charges not included in the Price shall be borne by the client. Any refusal by the client to pay customs and duties does not constitute non-delivery by YSP and does not trigger any refund or other rights of the client under these GCS.

5.          Payment, Insurance and Ownership of the Rings

a.                  Payments shall be made in advance of the shipment via a card or wire transfer method, through the Site-embedded payment infrastructure.  

b.                 Once the Price has been received in full by YSP under the Unconditional Purchase or the Conditional Purchase, YSP will send you an order confirmation by e-mail (the Order Confirmation).

c.                  Note that your Ring will not be manufactured prior to the payment of its full Price. Your Ring will be sent to you only once the full Price has been received by YSP.

d.                 Our Rings remain the property of YSP until the full Price has been paid by the client. YSP is maintaining insurance over the Rings until they are delivered to the client. The responsibility for the Rings passes to the client when the carrier delivers the package or when the carrier hands the package over to the recipient.

e.                  Once responsibility for the Rings has been transferred to the client, the latter shall be solely responsible for complying with all applicable laws and regulations relating to the possession, transport, use, and potential resale of the Rings.

6.          Ring Size Measurement

a.                  Following the Order Confirmation, YSP will send a measurement form to be completed by the client.

b.                 YSP will craft the Ring in accordance with the ring size specified by the client in the measurement form, provided that within two (2) weeks from the notification of the measurement form sent by YSP, the client obtains a professional measurement for the Ring size and returns the measurement form completed accordingly to YSP. Subject to the timely receipt of the completed measurement form, YSP will craft the Ring in accordance with the ring size indicated therein.

c.                  If the client does not revert the completed measurement form within such two-week period, YSP will automatically manufacture and deliver the Ring in the default size specified by YSP. In such case, the client acknowledges and accepts that (i) the Ring will be produced in the default size, (ii) any dissatisfaction arising solely from the absence of a timely submitted measurement shall not constitute a defect, non-conformity or delivery failure attributable to YSP, and (iii) any exchange, remake or return on that sole ground shall remain subject to YSP’s goodwill.

7.          Third-party E-Commerce Platform and Timestamps

a.                  YSP shall not be liable for temporary interruptions, delays, technical malfunctions, or unavailability of the Site or checkout process caused by third-party platforms or service providers.

b.                 Electronic records, confirmations, payment notices, and timestamps generated through the Site or the relevant third-party platform shall, absent manifest error, constitute valid evidence of an Order, the time of its placement, and related transaction steps (such as determining the place in the edition queue).

8.          KYC

YSP may perform Know Your Customer (KYC), anti-fraud, sanctions, export-control or similar verification checks, directly or with the support of relevant professional advisers or service providers, and to suspend or refuse an Order where necessary for legal, compliance or risk-management reasons.

9.          Delivery

9.1.          Place of Delivery

a.                  The Order will be delivered to the delivery address provided by the client, provided YSP is able to deliver to the country of destination. YSP only sends products to countries or regions specified on the Site from time to time.

b.                 YSP reserves the right, at its discretion, to refuse or cancel an Order where Rings cannot be sent to a specific country or person for logistical, legal, sanctions, export-control, payment, fraud-prevention or similar reasons.

9.2.          Delivery Trigger and Timeline

a.                  Subject to issuance of an Order Confirmation and timely receipt from the client of all information, approvals, measurements and payments required under these GCS, YSP shall use commercially reasonable efforts to ship the Ring within ninety (90) days from the receipt of the Ring size measurement form in accordance with Section 6.

b.                 If the client fails to provide the Ring size measurement form within the period set out in Section 6, the ninety (90) days period shall run from expiry of that two-week measurement period.

9.3.          Conditions of Delivery

a.                  If delivery by the carrier selected by YSP requires an appointment, the carrier will contact the client as soon as reasonably possible to arrange a delivery time.

b.                 YSP is not responsible for delivery delays caused exclusively by the unavailability of the client despite several appointment times having been proposed by the carrier.

c.                  YSP may require the collection of the client’s signature, or that of a designated representative, to confirm receipt of the product delivery.

9.4.          Impossibility of Delivery

In case of impossibility to deliver the Order due to circumstances attributable to the client, the Rings may be returned to YSP. The client may be required to bear any additional shipping costs and any other reasonable costs linked to a new delivery attempt.

10.          Reception and Verification

a.                  You (or your designated representative) are required to verify the quantity and condition of the Ring(s) upon delivery.

b.                 You must inform the carrier immediately upon receipt in the event of apparent breakage, visible defects, or visible damage affecting the package or the Ring.

c.                  You must also inform YSP by e-mail to sales@atelierysp.com immediately, but no later than twenty-four (24) hours after delivery, in the event of apparent breakage, visible defects, or visible damage affecting the package or the Ring.  

11.          Warranty

a.                  Subject to the limitations and conditions set out in these GCS, YSP warrants that each Ring is free from manufacturing defects for a period of two (2) years from the date of delivery to the client (the Warranty). This Warranty applies exclusively to manufacturing defects and excludes any other warranty. No other contractual remedy shall apply, except as required by applicable mandatory consumer law, if any.

b.                 This Warranty does not apply to, and the client may not assert any claim under the Warranty in respect of:

aa.               any damage caused or aggravated by an act or omission of the client, its representatives, agents, or any third party;

bb.              any damage resulting from theft, loss, force majeure, natural events, animals, mishandling, impact, or accident;

cc.               normal wear and tear, aging, scratches, oxidation, discoloration, or any deterioration resulting from ordinary use or the passage of time;

dd.              any damage resulting from resizing, alteration, repair, servicing, tampering, or any other intervention carried out by any person other than YSP or a service provider expressly authorized by YSP; and

ee.               any indirect, incidental, special or consequential loss or damage arising out of or in connection with a defect, to the extent permitted by mandatory law.

c.                  Any claim under the Warranty must be notified to YSP by e-mail to sales@atelierysp.com within five (5) days after discovery of the alleged defect, together with a description of the issue and any supporting photographs or information requested by YSP.

d.                 Upon request of YSP, the client must return the Ring to YSP, or to a service provider designated by YSP, in accordance with the return instructions communicated by YSP, for inspection and assessment.

e.                  The costs and risks of transport to YSP or to the designated service provider shall be borne by the client. If YSP confirms that the claim is covered by the Warranty, YSP may reimburse reasonable return shipping costs and shall bear the cost of reshipment following repair, replacement or remake.

f.                  In the event of a valid claim under the Warranty, YSP shall, at its sole discretion, repair the Ring, replace it, remake it, or refund the price paid for the defective Ring, in whole or in part.

12.          Right of Withdrawal for Default-Sized Rings Only

a.                  For default-sized Rings only (i.e., Rings for which no measurement has been timely notified by the client in accordance with Section 6), you have the right to cancel the contract created by the Unconditional Purchase or the Conditional Purchase, without giving any reason, fourteen (14) days from the day on which you acquire, or your nominated recipient (other than the carrier) acquires, physical possession of the Ring(s). If more than one item is ordered under the same contract, then the cancellation period ends at the end of fourteen (14) days from the day on which the last of the Ring(s) comes into your, or your nominated recipient’s, possession.

b.                 The return shipping costs (including tax and customs duties) are at the expense of the client. 10% of the Price shall be retained to cover the administrative and logistic costs incurred by YSP and to compensate for the fact that another YSP customer could have reserved the Ring in the meanwhile.

c.                  YSP will complete and strict examination of the condition of the returned Ring and will refuse any Ring showing any sign of wear and tear or modification from its original condition.

d.                 If you wish to exercise your right of withdrawal, you must abide by the following rules:

aa.               Within fourteen (14) days after delivery of the Ring, (i) notify YSP of your intention to withdraw by e-mail to sales@atelierysp.com, (ii) or fill in and send by registered mail the withdrawal form available below.

bb.              Within another period of fourteen (14) days after notification of your intention to withdraw, return the Ring in its original and complete packaging by courier to the provided address.

cc.               The Ring must be returned in its original condition in a new, unused and perfect state, with all protection, tags and stickers attached to it, with the original box and delivery package, including all accessories and documentation. YSP will refuse returns if the Ring shows signs of wear or has been used or altered from its original condition in any way.

dd.              The cost of returning the Ring may vary depending on the country of return. It can in principle be estimated on the carrier’s site according to the weight and dimensions of the package. You are responsible for the cost of returning the Ring(s) as well as to insure the Ring for the return shipping.

ee.               An e-mail will be sent to you as soon as we have received your package. We will proceed with the refund within fourteen (14) days from the date of receipt of the withdrawal request provided all conditions for refund are strictly met (see requirements on the condition of the Ring above). This period can be extended if the Ring has not yet been received by YSP. The refund will be made on the same payment method as the one chosen for the initial transaction. YSP will deduct from the Price the cost of the first shipping to your delivery address, any custom duties and a compensation fee as indicated above.

13.          Intellectual Property

All trademarks, names, logos, artwork, product visuals and other intellectual property rights relating to the Rings, including any reference to FIFA World Cup 2026™, remain the property of their respective owners or licensors. No transfer or grant of intellectual property rights may occur by reason of the sale of a Ring. The client may not reproduce, commercialize, adapt, market or otherwise exploit any protected artwork, trademarks or branding associated with the Rings.

Should you have any questions or requests related to these GCS or the Ring, you can contact YSP through the contact details indicated on the Site. YSP will process your request as soon as reasonably possible.

15.          Miscellaneous

15.1.          Data Protection

Your personal data will be collected exclusively in accordance with legal requirements and will be processed as defined in our Privacy Notice.

15.2.          Force majeure and Liability Exclusions

a.                  YSP rejects any liability for delays caused by events beyond our control, such as force majeure (including, but not limited to, epidemics, traffic congestion, wars and geopolitical crisis, extreme weather conditions or the holding of goods by customs or public authorities) or important technological issues. Such events do not entitle the client to withdraw from the contract or to claim compensation from YSP for the damage caused.

b.                 YSP will contact you as soon as reasonably possible to notify you (unless it proves to be impossible or would involve disproportionate effort). Our obligations under the GCS will be suspended and the time for performance of our obligations will be extended for the duration of the event beyond our control.

15.3.          Validity of the General Conditions of Sale

Should any provision of these GCS be declared null and void or partially invalid, the validity and scope of the remaining provisions shall remain unaffected. The invalid terms will be replaced by the applicable legal provisions.

15.4.          Limited liability

a.                  Without prejudice to the scope of these GCS, where specific liability caps or limitations may apply, no claim whatsoever relating to a Ring delivered or the non-delivery of a Ring or any other claim may exceed the Price of a Ring.

b.                 In any case, YSP must be informed immediately of all losses, damages, destruction and theft of Rings and be provided with all the necessary information concerning the cause and the specific circumstances.

15.5.          Applicable law

These GCS are governed by the laws of Switzerland, without reference to its conflicts of law rules. The application of the 1980 United Nations Convention on Contracts for the International Sale of Goods is expressly excluded. This provision shall not, however, deprive the consumer of any mandatory provisions from which no derogation may be made under the law of the country of the consumer’s habitual residence.

15.6.          Jurisdiction

You are encouraged to contact YSP’s customer service to seek an amicable resolution to any dispute. Failing such amicable resolution, the exclusive place of jurisdiction shall be the courts of the Canton of Geneva, Switzerland, except for mandatory places of jurisdiction as provided by law. Appeal to the Swiss Federal Supreme Court is reserved.

The revocation shall only be valid if it is addressed, legibly and fully completed, before the expiry of the 14-day period.
