YS Partners SA (YS Partners) respects your right to privacy in the online world when you use our Sites. This privacy notice (the Privacy Notice) explains how and for what purposes we use the information collected about you through our Sites.

We process your personal data under this Privacy Notice in compliance with applicable privacy and personal data laws according to the GDPR (General Data Protection Regulation / Regulation (EU) 2016/679) and the Swiss Federal Act on Data Protection (FADP).

1.          Scope Of This Privacy Notice and Your Consent

By using our Sites or by giving us your personal data, you accept the practices described in this Privacy Notice. If you do not agree to this Privacy Notice, please refrain from using or visiting our Sites or providing personal data.

YS Partners reserves the right to make any changes and corrections to this Privacy Notice. Please refer to this page from time to time to review this Privacy Notice and any new additional information.

2.          What Personal Data Do We Collect About You?

We only collect personal information that is necessary for a specific purpose or that you provide us with your consent, based on your actions and behaviors or for a legitimate reason:

–         personal contact information such as gender, age, name, full address and email, telephone number or geographic location;

–         information related to your orders and purchases placed on our website, such as the product purchased and shipping address;

–         information about your product, such as serial number, date and place of purchase;

–         payment information, such as credit cards, and billing addresses;

–         your comments and user-generated content, including any photos, videos and personal stories that you share with us;

–         your profiles on social networks;

–         your preferences regarding our products.

We collect this information directly from you.

We also use cookies and other tracking technology which collect certain kinds of information when you interact with our Sites or open our emails, such as IP addresses, devices or browsing preferences. You can find more information in the cookie notices of the Sites.

We may collect personal data about you from third party data aggregators (e.g. Google), promotional partners, public sources and third-party social networking sites. Such information may include personal data as part of your profile on a third-party social network and that you allow that third party to share with us, pursuant to their rules.

3.          Why Do We Collect Personal Date and Use It?

We may collect and use your personal data for several purposes and on the following legal basis:

Contractual basis:

–         to fulfil your orders and purchases, including after sales service;

–         to respond to your queries or share them with our partners so that they respond to you in your language or in relation to your country of residence;

–         to respond to job offers or job enquiries;

–         to provide products and services as well as assistance from customer support;

–         to manage your account, including your content, preferences, and collected measurements.

Based on your consent:

–         to contact you for marketing purposes and/or send you our newsletter;

–         to provide the best user experience possible on our Sites;

–         to provide marketing, advertising and recommendations as to products, features and events.

Based on our legitimate interest:

–         to perform Know Your Customer verifications (KYC) to prevent fraud and other prohibited or illegal activities, in line with applicable regulations and laws;

–         to let you know about different but related offerings to your purchases that may be of benefit to you;

–         for security and maintenance of our Sites;

–         to improve products and services by using anonymized data for software improvement and customer experience enhancement.

Based on our legal obligations:

–         for reporting purposes as well as risk, dispute, and/or record management to comply with our legal and financial obligations or to aid in dispute resolution.

4.          With Whom Do We Share Personal Data and Are the Data Transferred Abroad?

We may disclose your personal data to the following internal and external recipients:

–         our partners and our after-sales service center;

–         our service providers who assist us in operating our business and the Sites, such as consultants, hosting providers, e-commerce platform providers (including Shopify), payment service providers, Know Your Customer providers, logistics providers, marketing agencies, analytics providers, and IT support providers;

–         authorities if so requested by law.

The Sites may use third parties such as network advertisers and ad exchanges to serve you ads on third party websites after you leave our Sites, and we may use third party analytics and other service providers to evaluate and provide us and/or third parties with information about the use of the Sites. Please refer to the cookie notices of the Sites.

In connection with the operation of our e-boutique, we use Shopify as the platform provider. In this context, personal data relating to your use of the e-boutique and your orders — such as identification and contact details, order information, payment-related information, device and browsing data, and communications related to your purchase — may be processed by Shopify and its affiliated entities on our behalf for the purposes of hosting the online store, providing checkout functionality, processing orders, fraud prevention, platform maintenance, and analytics. Please refer to the privacy notice of Shopify.

As a rule, we seek to process and store personal data in Switzerland, the European Union (EU), and the European Economic Area, except for addressing shipping orders to countries outside these territories and the transfer is necessary for the performance of your contract with us.

However, if you consent to receive product information, personalized offers and marketing communications by email, we may share your email address with our partners involved in sales and marketing activities in Switzerland, the EU, and the European Economic Area. and/or in other countries where YS Partners is active, such as the United States. This includes cases where your data has been collected via lead generation campaigns conducted on third-party platforms such as Meta (e.g. Facebook or Instagram) and is transferred to our partners operating in those regions, as expressly agreed to in the lead’s consent. These countries may not all provide an adequate level of data protection under Swiss and European law. While YS Partners requires its retail partners to ensure an adequate level of protection for cross-border transfers, we cannot fully eliminate the risk that your data may not benefit from protections equivalent to those provided in Switzerland or the EU.

In addition to these marketing-related transfers, some of our providers are also located in the United States or Canada (in particular, Shopify) or have entities in the United States or Canada besides their offices and/or entities in the European Union. It is therefore important to note that your personal data may be transferred to these territories.

We also use Google Analytics (GA) and other tools proposed in its suite, as well as the Facebook pixel, which may lead to data transfers to the United States. For more information on GA and how to disable it, please see our cookie notice.

We require third parties, who may be based outside the country from which you have accessed the Sites, to comply with all relevant data protection laws. In addition, third parties are only allowed access to your personal data and use it on our behalf in relation to the specific tasks assigned to them, based on our instructions.

In any case where cross-border transfer is done, we request from our partners that an adequate protection is guaranteed for personal data to be transferred outside of Switzerland, the EU, and the European Economic Area.

We might propose social plugins, in which case we may collect and process information relating to your account on social media platforms. The third-party platform’s use of information collected from you (or as authorized by you) is governed by its own privacy policy and your settings on the service.

5.          How Do We Host, Process, Store, Secure and Retain Data?

Data hosting and processing mainly take place in Switzerland, the EU, and the European Economic Area. However, depending on the services used, certain processing activities may also take place in other countries, including the United States and Canada (in particular, for the needs of Shopify), subject to appropriate safeguards where required by applicable law.

We take all reasonable technical and organizational measures to protect the personal data we hold against loss, unauthorized access or disclosure and against other misuse. Your personal data will not be sold or disclosed to any other third parties except as provided in the Privacy Notice.

We retain your personal data only for as long as necessary to fulfil the purposes for which it was collected, such as providing our services through our Sites and to comply with legal, regulatory, or contractual retention obligations. To determine the appropriate retention period, we also consider the nature, quality, and sensitivity of the data. For example, data related to a contract may be kept for the duration of the contract and up to ten years thereafter, in accordance with legal obligations. If processing is based on your consent, your data will be deleted upon withdrawal of that consent, unless we are legally permitted or required to retain it (e.g. to establish, exercise, or defend legal claims). Once the applicable retention period has expired, your data will be securely deleted or anonymized.

You have the following rights in relation to your personal data:

–         you have the right to be informed about how your personal data is processed and access to your personal data at any time by contacting us at sales@atelierysp.com;

–         you have the right to rectify your personal data or to have your personal data erased under certain conditions;

–         you have the right to restrict the processing of your personal data under certain conditions and, when based on legitimate interest, you have the right to object to the processing;

–         when based on consent, you have the right to withdraw your consent at any time;

–         you have the right to data portability, that is, to receive the personal data in a structured, commonly used format and to transmit those data to another controller without hindrance from us.

You can also limit the use of tracking technologies, such as cookies, by configuring your browser to warn you before accepting them, or you can simply configure it to refuse them.

If you feel that we are not respecting your rights or our obligations, you can lodge a complaint directly with your data supervisory authority at any time, in Switzerland with the Federal Data Protection and Information Commissioner.
